Neglect vs. Gross Negligence: Key Lessons from Recent Tax Court Decision
November 10, 2025
Did you know that government-issued cheques from the Canada Revenue Agency (CRA) never expire? Whether it’s a GST/HST credit, tax refund, or other payment, these cheques can be cashed at any time—even years later. If a cheque has been lost or damaged, it can be replaced upon request.
To find out if you have any uncashed cheques, simply log in to your CRA “My Account.” On the “Overview” or “Accounts and payments” page, select “Uncashed cheques.” If any are listed, you can download and print Form PWGSC 535 (Undertaking and Indemnity) to request a replacement.
A recent article by Christopher Nardi in the National Post (May 12, 2025) revealed that the CRA is currently holding over 10 million uncashed cheques, totaling approximately $1.7 billion. While most are under $1,000, nearly 190,000 cheques exceed that amount, and 160 are worth more than $100,000. Some date back as far as 1998.
This is a timely reminder to check your CRA account—you might be one of the Canadians owed money. It’s a simple process that could result in a pleasant surprise. Don’t let your funds go unclaimed!
